Tesla is Suing the Indian Battery Maker for Trademark Infringement

Tesla, the electric car maker owned by Elon Musk, has filed a lawsuit against an Indian battery maker for using the “Tesla Power” brand to promote its goods. Tesla is asking a New Delhi judge to pay compensation and make a permanent injunction against the Indian battery maker.

 

At a hearing in the Delhi High Court last week, Tesla said it had continued to use the “Tesla Power” brand to advertise its products despite the court noticed the Indian battery maker in April 2022 to stop using the brand.

At the hearing, the Indian company, Tesla Power India Pvt Ltd, argued that its main business was producing “lead-acid batteries” and they don’t have intention of producing electric cars. After the Indian company filed a set of documents that supporting its defense, the judge allowed the company to file a written response within three weeks.

 

Tesla, which is incorporated in Delaware, has accused the Indian company of using the trademarks “Tesla Power” and “Tesla Power USA.” Court records include screenshots of a website where the company claims that Tesla Power USA is also headquartered in Delaware and its “recognized as a pioneer and leader in the introduction of affordable batteries” with “a very strong presence in India.”

 

Manoj Pahwa, a representative of Tesla Power India, told the media that the company had entered the Indian market long before Musk’s Tesla and had obtained approvals from all government departments. “We have never claimed to be associated with Elon Musk’s Tesla” he said.

 

Tesla told the judge it was forced to file the lawsuit after it discovered the Indian company was using its brand name in 2022 and tried unsuccessfully to stop the infringement.

 

The case comes after Musk canceled a planned visit to India on April 21 to meet with Indian Prime Minister Narendra Modi. Musk made a surprise visit to China and made progress on the launch of an advanced driver assistance software. Many Indian commentators said Musk was snubbing the Indian market by canceling the trip and visit China instead.
